Do I Legally Have to Service My Oil Boiler?
By Advanced Oil Boiler Services · Published

The short answer is no. No law in the UK requires a homeowner to service an oil boiler every year, and no recent change to the building regulations has made it a legal requirement.
You'll find plenty of claims online that it is. We checked the legislation and the official guidance, and this is what actually applies. There are still good reasons to book a service every year, and your guarantee or your insurance may depend on it.
What the law says for homeowners
In England, the building regulations set rules for how an oil boiler is installed: its air supply, its flue and how its fuel is stored (Part J of Schedule 1 to the Building Regulations 2010). They don't require you to have it serviced.
The official guidance on those rules, Approved Document J, says regular servicing is essential. But approved documents are guidance, and the document itself says there is no obligation to adopt any particular solution in it.
What about landlords?
Landlords often assume oil heating works like gas. It doesn't. The annual gas safety check under the Gas Safety (Installation and Use) Regulations 1998 applies to gas appliances only.
OFTEC, the body that registers oil heating technicians, puts it plainly: there is "no legal requirement in the United Kingdom or the Republic of Ireland for a landlord to obtain a landlord safety certificate for oil or solid fuel heating equipment".
Landlords in England do still have to keep the heating in repair and proper working order (Landlord and Tenant Act 1985, section 11). Since 1 October 2022 they must also fit a carbon monoxide alarm in any room used as living accommodation that contains a fixed combustion appliance, which includes an oil boiler. OFTEC recommends that rented homes with oil heating have it serviced at least once a year.
The rules differ in Wales, Scotland and Northern Ireland, mainly around carbon monoxide alarms, but none of them sets an annual servicing requirement for oil.
Why a yearly service still matters
- OFTEC recommends it: a service at least once a year by an OFTEC registered technician.
- Your guarantee may depend on it. Grant extends its guarantee only if the boiler is "serviced at twelve monthly intervals", and Worcester Bosch says "yearly servicing is a condition of our manufacturers guarantee".
- Your insurance may depend on it. Some home insurance policies won't pay for a breakdown if the boiler hasn't been serviced in the previous 12 months, so check your own policy wording.
- Safety. A service checks the boiler and its safety systems. Building regulations guidance says a carbon monoxide alarm "should not be regarded as a substitute for the correct installation and regular servicing" of a boiler.
Where the "it's the law" idea comes from
Two real rules tend to get mixed up with servicing. Landlords must have gas appliances safety-checked every 12 months, and that is often assumed to cover oil too. And since 1 October 2022, building regulations guidance in England says a carbon monoxide alarm should be fitted in the same room when a new or replacement oil boiler is installed. Neither rule makes an annual oil boiler service compulsory.
